Privacy Policy

Sync Garden ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how Sync Garden ("we") collects, uses, and shares information when you use our Sync Garden mobile application (the "App"). By using the App, you agree to the collection and use of information in accordance with this policy.

1. Data We Collect

Account information

When you create an account or sign in, we collect:

  • Email address and password (for email/password sign-in; your password is stored in hashed form).
  • If you sign in with Google or Apple, we receive from the provider: email, display name, and profile photo (where made available by the provider). We use this to create or update your account in our systems.

This account data is stored in Firebase Authentication and in our Firestore database (user profile document).

Usage and analytics

We use analytics services to understand how the App is used and to improve it. This may include:

  • Device and app usage data (e.g., screen views, in-app actions such as starting or completing the daily game).
  • User identifier (a unique ID linked to your account when you are signed in), so we can associate usage with an account for analysis.

This data is sent to:

  • Firebase Analytics (Google)
  • Mixpanel

Each of these services may collect additional data as described in their respective privacy policies. We do not control their data practices; we encourage you to review their policies.

Error and crash data

We use Sentry to help us fix errors and crashes. Sentry may receive:

  • Crash and error reports (e.g., stack traces, error messages).
  • Navigation breadcrumbs (screens or actions you took before an error).

We do not use performance or profiling tracing in the App; only error/crash-related data is sent to Sentry.

Feedback

If you choose to submit feedback after a session, we collect and store:

  • Star rating and answers to our feedback questions.
  • Free-form text you enter.

This feedback is stored in our Firestore database and is linked to your user ID and timestamp. Submission is optional.

Local preferences

We store on your device only (using local storage, not our servers):

  • Language/locale preference (e.g., English or Simplified Chinese).

This data is not sent to our servers or third parties for storage.

2. How We Use Your Data

We use the information we collect to:

  • Provide the App (e.g., authenticate you, show your progress, run the daily game and affirmation experience).
  • Improve the App (e.g., analyze usage via Firebase Analytics and Mixpanel to improve features and design).
  • Fix problems (e.g., use Sentry to diagnose and fix crashes and errors).
  • Process feedback you submit (e.g., to improve content and experience).
  • Communicate with you if necessary (e.g., account or security-related messages).

We do not sell your personal information to third parties.

3. Legal Basis (EU/UK)

If you are in the European Economic Area or the United Kingdom:

  • We process your data where necessary for contract (providing the App), legitimate interests (analytics, error fixing, improvement), or consent where we ask for it.
  • You may have the right to withdraw consent or object to certain processing. You can contact us (see Contact below) to exercise these rights.

4. Third Parties and Sharing

We use the following third-party services, which may receive or process data as described in their privacy policies:

  • Firebase (Google) — Purpose: Authentication, database, analytics. Data involved: Account data, usage/analytics data (see Firebase Privacy).
  • Google Sign-In — Purpose: Sign-in with Google. Data involved: As per Google's privacy policy.
  • Apple Sign-In — Purpose: Sign-in with Apple. Data involved: As per Apple's privacy policy.
  • Mixpanel — Purpose: Product analytics. Data involved: User ID, events, screen views (see Mixpanel Privacy).
  • Sentry — Purpose: Error and crash reporting. Data involved: Crash/error data, breadcrumbs (see Sentry Privacy).

These providers may be located in the United States or other countries. We ensure appropriate safeguards (such as standard contractual clauses where required) for international transfers.

We do not sell your personal data. We may disclose your information if required by law or to protect our rights, safety, or property.

5. Data Retention

  • Account data: We retain your account and profile data until you delete your account. When you delete your account, we remove your user document and associated account data from our systems.
  • Feedback: We retain feedback (linked to your user ID) until you delete your account, after which we remove or anonymize it in line with our deletion process.
  • Analytics and crash data: Retention is governed by the respective provider policies (Firebase, Mixpanel, Sentry). We do not control how long they keep data; some data may remain in their systems after account deletion.

6. Your Rights

Depending on your location, you may have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate data.
  • Delete your data (including via Delete account in the App).
  • Data portability (e.g., a copy of your data in a structured format).
  • Object or restrict certain processing.
  • Withdraw consent where processing is based on consent.
  • Lodge a complaint with a supervisory authority in your country.

Deleting your account: In the App, go to Settings → Account Deletion and follow the steps. This will delete your Firebase Auth account and your user document in our database. We will also remove or anonymize your feedback. Data already shared with analytics or crash-reporting providers may remain in their systems according to their policies.

7. Security

We use industry-standard measures to protect your data, including:

  • Firebase for secure authentication and database access.
  • HTTPS and secure connections for data in transit.
  • Secure handling of credentials (e.g., hashed passwords, OAuth tokens).

No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

8. Children

The App is not directed at children under 13 (or under 16 in some jurisdictions). We do not knowingly collect personal information from children. If you believe we have collected data from a child, please contact us and we will delete it promptly.

9. International Transfers

Your data may be processed in countries outside your residence (including the United States) by us or our service providers. Where required by law, we use appropriate safeguards (such as standard contractual clauses) for such transfers.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy in the App or on our website. The "Last updated" date at the top will be revised. Your continued use of the App after changes constitutes acceptance of the updated policy.

Welcome to Sync Garden. These Terms of Service ("Terms") are a contract between you and Sync Garden ("we," "us," or "our"). By downloading, installing, or using the Sync Garden mobile application (the "App"), you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance and Eligibility

By using the App, you confirm that you:

  • Are at least 13 years of age (or the minimum age required in your jurisdiction to use the App), or have parental or guardian consent.
  • Have the legal capacity to enter into a binding agreement.
  • Will comply with these Terms and all applicable laws.

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Sync Garden provides a daily, kin-based coloring, reveal, and affirmation experience. The App includes features such as:

  • A "today's game" flow (intro, sharp area interaction, sticker placement, color reveal, final image, affirmation, optional practice and feedback).
  • Account creation and sign-in (email/password, Google, or Apple).
  • Language options (e.g., English and Simplified Chinese).
  • Optional feedback submission and in-app settings.

We provide the App "as is" within the scope of its current features. We may change, suspend, or discontinue features or the App at any time, with or without notice, to the extent permitted by law.

3. Account and Eligibility

  • You must provide accurate and complete information when creating an account.
  • You are responsible for keeping your account credentials secure and for all activity under your account.
  • You may have one account per person. Do not share your account with others or create multiple accounts to abuse the service.
  • You must notify us promptly of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the App (except where expressly permitted by law).
  • Scrape, harvest, or collect data from the App or its users in an automated or unauthorized way.
  • Circumvent any access controls, security measures, or usage limits.
  • Interfere with or disrupt the App, servers, or networks.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Use the App to distribute malware, spam, or harmful content.

We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.

5. Intellectual Property

All content in the App—including but not limited to text, images, artwork, designs, graphics, audio, video, and software—is owned by Sync Garden or its licensors and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, in accordance with these Terms. You may not:

  • Copy, modify, or create derivative works of the App or its content.
  • Use the App or its content for any commercial purpose without our written permission.
  • Remove or alter any copyright, trademark, or other proprietary notices.

6. Subscription and Payments

The App offers optional auto-renewable subscription plans that unlock premium features. The current plans are:

  • Sync Garden Premium — Annual Plan (auto-renewing, billed once per year).
  • Sync Garden Premium — Monthly Plan (auto-renewing, billed once per month).

Pricing for each plan is displayed in the App before purchase and may vary by region and currency. You can review the current price on the subscription screen in the App or on the applicable store listing.

Billing: All payments are processed through the platform you use to download the App (Apple App Store or Google Play). By subscribing, you authorize the platform to charge the applicable fee to your account.

Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of your chosen plan.

Free trial: If a free trial is offered, any unused portion of the trial is forfeited once you purchase a subscription.

Cancellation: You may cancel your subscription at any time through your device's subscription settings (Apple App Store or Google Play). Cancellation takes effect at the end of the current billing period; you will retain access to premium features until that date. Cancelling does not entitle you to a refund for the current period.

Refunds: Refunds are handled by the applicable platform (Apple or Google) in accordance with their refund policies. We do not process refunds directly. If you believe you are entitled to a refund, please contact Apple Support or Google Play Support.

Changes to pricing or plans: We may change subscription pricing or available plans at any time. Price changes will not affect your current billing period; any increase will take effect at the next renewal, and the platform may notify you in advance as required.

Non-subscription features: Core features of the App (such as the daily game) may be available without a subscription, subject to usage limits we may apply from time to time.

7. Termination

By you: You may stop using the App at any time. You may also delete your account via Settings → Account Deletion in the App. Account deletion will remove your account and associated data as described in our Privacy Policy. Deleting your account does not automatically cancel an active subscription; you must cancel your subscription separately through your device's subscription settings before deleting your account.

By us: We may suspend or terminate your access to the App, with or without notice, if we believe you have breached these Terms, violated applicable law, or for operational or legal reasons.

Effect of termination: Upon termination, your right to use the App ceases. Provisions that by their nature should survive (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive termination.

8. Disclaimers

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure. The wellness, affirmation, and meditation-style content in the App is for general support only and is not a substitute for professional medical, psychological, or other advice. Consult a qualified professional for health or mental health concerns.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE (AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL) ARISING FROM OR RELATED TO YOUR USE OF THE APP.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such cases, the above limitations apply only to the extent permitted by law. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sync Garden and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the App.
  • Your violation of these Terms or any applicable law.
  • Your violation of any third party's rights.
  • Any content or data you submit or transmit through the App.

11. Governing Law and Disputes

If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection laws, you may also have rights under those laws that cannot be limited by these Terms.

12. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or by other reasonable means (e.g., in-app notice or email). The "Last updated" date at the top will be revised. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the App and may delete your account.

13. Severability and Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any other policies we make available in the App, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
